Legal Question in Criminal Law in California

Availability of federal agency personnel

Must federal agencies make there personnel available to testify in court? If the Government agency initiated the investigation and filed charges through a state county, does the agency that did the investigation have to make their employees(and Investigators) available when requested?

You should obtain a subpoena for each of the individuals which you wish to call as witnesses. If it is a civil case you may have to pay for the costs of the witness appearing in your case. you will also have to hire a process server to personally serve the subpoena. It is probable that you can serve the government agents at the office in which they are employeed.

In a criminal case you have the right to have these persons subpoenaed without cost to you.

Any and all relevant witnesses can be made available to you in your criminal trial, This is called "confrontation" that is your right to have the courts produce all witnesses relevant to the issues in your trial through the subpeona powers of the courts. This applies to federal oficials as well as any other potential witness. The big question is whether that witness has information that is relevant to the issues to be presented at your trial....good luck,,pdm
