Is there any possible way at all to avoid a first time misdemeanor theft charge? There's Safeway video tape footage...

How would any attorney know without reading the police report and looking at the footage? Theft charges need to be fought, or else you won't work again.

Don't do the crime.

Can your attorney negotiate a plea bargain on charges that have been filed? Maybe. He'll know once he has all the facts, evidence, etc. and deals with the DA and court.

Can your attorney negotiate a deal with the store quickly enough to not file criminal charges. Maybe. He won't know unless he tries and offers them enough money to make the offer attractive to them.
