Legal Question in Criminal Law in California

The cops came to my house and arressted me and one other person my charges were harboring a place for sales of a controlled substance and my codefendants charge started out as a sales charge but they never filled on him they only filled a POSSESION charge which he has been sentenced for already the drugs were his he admitted that so how am I still being charged with harboring a place for sales when no one was charged with sales ? Shouldn't that be dismissed ? They r threating me with 365 days in jail for this ...

First you need an attorney. Second maybe he made a deal... If they can prove the underlying facts that meet the elents of the statute you can be convicted.

Your focus and questions are off base.

When charged with any crime, the proper questions are, can any evidence obtained in a test, search or statement be used against you, can you be convicted, and what can you do? No amount of free 'tips and hints' from here or elsewhere, or our 'opinions' are going to effectively help in a legal defense. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.
