Legal Question in Criminal Law in California

cops did a search warrant on my house for drug sales and found oz of meth, they took 2 tv , 4 tablets, 2 laptop computers and 600 in cash, how would i go in getting my stuff back, if some of the things werent mine. my kids all have tere own tablets they got as gifts , and fix electronics and buy and sale on craigslist and ebay.

If you have a criminal case pending you will have to wait until the case is over. Then you can make a motion for return of property. If there is a forfeiture case pending you will have to fight it out in a civil court action. If you get a forfeiture notice make sure you comply with filing deadlines. But the actual case will have to wait until any criminal case is over. If no criminal case has been filed but it is within the statute of limitations, you are best off doing nothing at this point since anything you say in the civil case can be used against you in the criminal case. Whatever you do. you should not talk to any law enforcement officers and you should give no one consent to search your house.
