Legal Question in Criminal Law in California

A corrupt roomate...

I have a roommate that has preferred for the last 8 months that he be the only one to have a key to the mailbox. I never really questioned it because my mail was always delivered promptly. That is until I noticed a check from the government that I receive every month wasn't coming in. I called the office that mails the check and they told me it was indeed mailed and had actually been cashed. I never received the check nor did I ever cash it. It wasn’t until I received the copy of the check that I realized my roommate was the guilty party. The signature on the check and the one on his passport were two in the same and it was cashed at his bank. I confronted him about it and he is completely denying it! He said that his bank doesn’t take third party checks and if he did indeed cash it, they would make him put his thumb print on it. I then asked him to get a copy of his bank statement for me to review to prove his innocents and he said his bank could not give him a copy of his bank statement past 60 days and that they would need to order his statement from there corporate office in Oregon. How do I prove he is the one who opened my mail, forged my signature and stole my money? Can I put his behind in jail for this?

Get a photocopy of that passport if you can (or a photograph of it). Then call the cops. You can file a police report and they police will likely turn the file over to the district attorney.

You should also consider contacting the government agency that issued the check and report the theft. That agency can get a copy of the check and determine what account it was deposited into. This may give faster results than contacting the police.
