Legal Question in Criminal Law in California

criminal defense

i was recently pulled over. I have license and insurance and the car I was driving was not in my name. They found meth and a gun wich I have a permit to carry.I had someone with me also and he got dismissed because they couldnt prove the probable cause for search. will that mean on my next court date it will get dismissed for me to?

Re: criminal defense

Charges against you might or might not get dismissed. Rules for probable cause relating to driver of a car and passengers are somewhat different. Lack of probable cause to search with respect to passengers does not necessarily mean lack of probable cause as to the driver.

Only a lawyer familiar with all the details of your situation could give you an educated estimate of what to expect. Consult or get one. If you cannot afford private counsel, make sure to be represented by a public defender. Do not attempt to represent yourself.
