Legal Question in Criminal Law in California

discovery

I am the victim in a domestic violence case and had surgery as a result. I have copies of medical reports from that hospital. Unfortunately, the reports are not entirely accurate (i.e. ''the assault took place on 4/3/09 and the victim was at home until 4/8/09 when she was then transported to...'' I was assaulted on 4/8 and was transported on 4/8. Do I have to give the DA's office the entire report including the inaccurate info? I'm afraid that thru discovery, the pd will try to destroy my credibility because of the doctors mistakes.

Why don't you try to get the hospital to correct it's report ?

Hiding any part of the record will do more to weaken your credibility than anything else. Get a copy of the ambulance bill and provide it in discovery too. That will prove when you went to the hospital. End of problem.

Chances are the DA's office will be requesting a copy of your medical records from the hospital directly and in turn, providing them to the Defense as required.

In any event, you should contact the DA's office and request to speak with the Deputy District Attorney who will be handling your case. Discuss your concerns and let him/her decide how to handle the date discrepancy.
