Drugs in Car

My daughter was arrested for possession of drugs. She denies they were hers. She was driving my husband's car and the drugs were found in it. She has been charged and goes to court soon. How do they prove the drugs were hers if it was someone elses car? And is it possible to prove they were not hers...and not incriminate anybody else?

Blaming someone else could get them charged. The car can be confiscated, but if not already done, may not be. Time for her to hire counsel to help.

If she does state that the drugs were someone else's and that she borrowed the car, the owner of the car or that someone else might well be implicated. What was the type and quantity of the drugs and where did the arrest take place? Many counties are much more lenient than others regarding drug offenses.

As stated, you will most likely need to consult an attorney to provide the best defense for your daughter. Your problem, as I see it, is that you also wish to avoid any implication as to how the drugs were in the car.
