embezzeling

i pocketed a $40 sale from the register and got caught..i paid my boss back. now my boss wants me to sign over my last check to her or she will press charges. what should i do?

Discouraging to learn that there are dishonest people who want to victimize you, isn't it? If it is not clear to you yet, no matter what this extortionist does and no matter what else you do, your life at that job is at an end. Start looking. Before you go, perhaps if this extortionist could be led to repeat the demands when someone is within ear shot, you would be able to see him/her prosecuted too.

However, do NOT record the conversation in secret, as this is just another criminal violation on your part. If you do decide to pay, try to do it in such a way that you will have proof of the payment.

The employer can have you arrested and charged, but should not be committing 'extortion' by threatening arrest in exchange for payment. What they are doing is wrong, but if you are sure it will end the risk of arrest, make a judgment call whether to pay it or complain to police of the 'extortion'. If arrested, you'll spend a lot more on attorneys than that. So, no easy answer. If you want to consult with or hire counsel to help you, feel free to contact me.
