Embezzlement & Fugitive

Hi,

My friend have been charge of Embezzlement last year. He was working for an big investment company and he stole more than one million from his multiple clients. Some of the client is out-state and some are international. Then he was scared and flee to another country. Right now he wants to plead guilt. Can he have a lawyer to go to negotiate to the Offense before he comes back to US to plead quilt?

Possibly. However, we're not talking about a minor offense with a slap on the wrist expected. This case needs to be discussed in detail, to determine what kind of plea bargain might be possible. The attorney will be able to arrange for a voluntary surrender, and will attempt to get an agreement with the prosecutor regarding potential bail and the terms of a 'deal'. Such voluntary surrender makes lower bail or Release on Own Recognizance possible. The attorney should also begin discussions with the victim company about restitution; as a deal with them would greatly help in negotiations with the DA. Yes, a lawyer is absolutely necessary here. When there is an arrest warrant, a good lawyer should be able to negotiate terms of surrender, bail and release, etc. The prosecution is always interested in bringing people to court so your friend has some leverage here, especially in a situation where he is abroad and wants to come back to face charges. The fact of the matter is that when a criminal complaint is filed and the defendant has fled the jurisdiction, he will be convicted in absentia. Meaning that most likely he is already convicted. Furthermore if the individual was a non U.S citizen this kind of conviction at the end of jail time can result in deportation with a minimum 10 year bar. You be the judge.
