expungement

30 years ago i was convicted of two misdemeanor drug possession charges. I am now applying for jobs with a local school district. will my convictions and fingerprints show up in the districts search of my past records. if so how can i have my records expunged. Thank You.

Without the cases being off your record, even though they are so old, they could theoretically be discovered by agencies interested in hiring you. Expungement is the precise legal mechanism to get the convictions off your record. We would file a motion with the court and a form to request the remedy from the judge and follow up with them on their response. All that you have to do is file is a 1203.4 motion with the court and it should be granted to expunge your record as long as you have completed your probation.

Then you can honestly answer on your applications that you have never been convicted of a crime because the motion asks the court to dismiss the charges against you. However, it will still serve as a prior if you get another one.
