Legal Question in Criminal Law in California

My best friend, a male, was arrested yesterday for DUI. The area of major concern is he violated parole. His charges are VC 23152(A) Misdemeanor (DRIVING UNDER INFLUENCE OF ALC AND/OR DRUGS) VC 23152(B) Misdemeanor (DRIVING WITH B.A. OF 0.08 PERCENT OR MORE), and the charge I'm inquiring about PC 3056 (VIOLATION OF PAROLE ). Can you estimate the sentence he may receive? How will he know if he's being offered the best (not sure what to call it) deal? He's to broke to have his own attorney & no offense but the appointed lawyers haven't exactly fought for the best outcome. He needs rehabilitation & job training not more jail time.

Thank You,

Meredith P.

While I do not do parole violation hearings, my understanding is your best friend can get up to 1 year for each parole violation. How much time, if any, he does will depend on many factors...ie.1)what charge he's on parole for 2) how long has he been on parole 3) How many times has your friend violated parole already, if any. 4) what has your friend been doing of a productive nature during the time he's been on parole. I'm sure there are other factors which a parole board will consider as well as the one's I've mentioned. Being on parole is not a right, by law...it is a priveledge. Therefore your friend needs to live a life evidencing his awareness of same.
