how to generally draft a mot 2 dismiss, PC 995 CA crim law
would you possibly provide some general verbiage . I have a client charged w/a 211 PC because b4 leaving a grocery store w/a $5.49 padlock he was accosted by a store loss prevention ofcr. This was captured on camera (dvd), but it is unclear whether my clien6t was trying to simply give the merchandise back & the LP guy flinched back in reaction. A security guard wit 2) stepped in front of the view of the scuffle & then wit 1 & 2 t6ook my client down--w/in the stores's curtilage. The prelim hrg transcript is somewhat inconsistent Re: wit 1's testimony of how my client ''struck'' him & the police report refleccts that there were no photos taken of wit 1, nor wwas there any otr evidence--besides the tape. Suggestions?
