Legal Question in Criminal Law in California

My girlfriend was arrested for possession of a controlled substance (meth) and paraphernalia.The thing is she didn't know it was in her purse. It was mine and didn't tell her I put it in there and she went to the store got pulled over and they found it. She goes to court tomorrow and has never been arrested before for anything. I can't be in court with her because of a doctors appointment.How do I appear in court and tell them It wasn't hers it was mine and she didn't know I put it in her purse.I know they won't believe her.I have been arrested for the same charge about 13 years ago and know how the system works. My question is can I say it's mine and will they let her go and can or will they charge me for it?

Unfortunately, they are not going to dismiss based on what you say. Also, they could charge you if you cop out to it. Your friend needs a good criminal defense attorney who can go over all the facts and defenses with her to analyze all options available. A felony is a serious charge and she should not try to handle it on her own.

It is very likely that you will be charged if you do this, and it is unlikely that the charges against your girlfriend will be dismissed. You and she need lawyers right away. You will each need your own lawyer, since representing both of you would pose a conflict of interests.
