Legal Question in Criminal Law in California

The ex that won't take the hint.

I have an ex boyfriend that has been an annoyance for about 7 years now. I have changed my phone number 2,3,4,5 times and I don't understand how he still manages to get the new number and call me. I have told him 100 times to leave me alone. How does one obtain a number you have changed and made private? Can I file a retraining order on him even though he only harrasses me via phone? Any advice would help.

Yes, a restraining order should be sought. If he then violates that, he faces serious charges. Contact me if interested in doing this properly.

Harassing phone calls are sufficient ground for a restraining order, and that seems to be your wisest course here. Clever investigators can find unlisted phone numbers, but how the ex-boyrfriens found your information is less important than what he is doing with it. He is using it to harass you, and evidently won't stop unless a court orders him to.

I agree with Mr. Hoffman but would amend to say that harassing phone calls MAY be the basis for a restraining order. It depends how often he calls, the date of the most recent call, and what he says when he calls.

Depending on the facts of your case, you may be able to obtain a domestic violence restraining order, because your caller is a former boyfriend. You may want to look for a legal aid clinic in your area that can advise you for free. Legal Aid of Orange County runs domestic violence courthouse clinics. Call 800 834-5001 or 714 571-5200 for more information and to see if there is a clinic in your jurisdiction.

I also recommend - if you are not doing so already - calling the police and making a harassing phone call report each time he calls, in order to make a record.
