Legal Question in Criminal Law in California

under the influence

I was pulled over for a burnt out headlight and started to have a panic attack...I had used some controlled substances earlier but I was not that high....My car was searched and nothing was found so the cop charged me with HS 11550 violation..My blood was focibly taken... I was booked and released five hours later.....I have a prior marijuana conviction from 1984 (19 yrs old) and nothing else.....

what can I expect on my first court date....

The first court date is an arraignment. The only thing that occurs is that you are told/given the charges against you, and a plea (not guilty, guilty, or no contest) is entered.

It would be helpful if you informed me what exactly you were on. Based on the facts you've given, you may want to further investigate your case. If so, enter a plea of no contest, go to the DA's office, and request a copy of the police report.

After that, you can decide whether to contest the charges or accept the punishment for the crime. It is most likely that you would receive diversion - treatment vs. incarceration. In order words, you would probably end up having to take some classes and attend meetings.

At the arriagnment you will be informed of the charges against you. You should plead not guilty and waive time. Prior to that date, attempt to hire an attorney. If you cannot afford hire an attorney then you should request that the court appoint an attorney to represent you.
