Legal Question in Criminal Law in California

loan fraud

I had a student loan with my ex fiance, that he co signer for around 20k.

We broke up and now he is claiming he never authorized that loan and submitted it to the fraud dept of the bank issued at and filed a police report saying that his signature was forged. I did sign the loan on his behalf, but I had his permission.

What are my legal options I have to protect myself? what is going to happen?

Also, I took out a seperate loan on my own to pay off this one when we broke up because he started threatening me.what should i do?

Re: loan fraud

Paying off the loan was a good move. Make sure there is no balance left and continue to act in good faith.

If there is a police report filed, you need an attorney to intervene as quickly as possible on your behalf in order to perhaps nip the whole thing in the bud before any charges are filed. This might prove very cost effective for you rather than having to deal with a long litigation.

You have some possible defense although the fact that you signed for him is a problem.

Re: loan fraud

You can not sign a legal document on behalf of another adult, unless you had a power of attorney to do so.

The bank can potentially institute fraud charges against you even though it sustained no damages. However given that you state the loan was paid off in full by a subsequent loan, it remains to be seen.

I recommend hiring me if anyone starts questioning you.
