Legal Question in Criminal Law in California

Lying on A Police Report

I called the police on my fiance and said he was beating me and keeping me hostage. They picked him up on a Parole Violation. I completely lied to the poilce, as he had done no such thing. I was high and drunk and very stupid. They are charging him with false imprisonment, corporal punishment on a spouse and having a controlled substance. The drugs were not his, but I said they were, however, the drugs were brought out of my jewelry box. My fiance did not even know I used drugs, or had them in the house. I already filled out a No Prosecution report and said that he never hit me, at the DA's office. I called the Sherrif the next day and admitted that the drugs were mine. What do I need to do to recant my statements and claim all responsibility for the drugs and the lying on the report. This is his second parole violation and it was all fabricated by me.

Re: Lying on A Police Report

You need to be as adamant and convincing about the fact that you are telling the truth now as possible. If that is the truth (is it, really?), that is what you need to do. The prosecution's belief will be that your initial statements were true and you are lying now to protect your boyfriend. You might have to actually prove to them in some way that you are being truthful now.

The big problem for your boyfriend is parole violation. They do not need to prosecute him to throw him back into prison. If you succeed in convincing the prosecution not to file charges, most likely you will need to do even more convincing to the parole officer.

Let the truth of this matter guide you. Good luck.
