Legal Question in Criminal Law in California

Marijuana

My daughters boyfriend was caught with marijauna. He was not arrested but told that he will be required to assist in undercover drug buys in the future to trap dealers. I would like to know if this is legal for the police department to require this of him. He bought what he had from a friend is very afraid to buy from strangers to assist the police in a bust. Thank you, Diana

This can be offered in exchange for dropping or reducing his charges...however, he cannot be forced to cooperate in this manner or make any statements to this effect.

Re: Marijuana

The police cannot "require" the young man to help them arrest drug dealers, but they can give him the choice of doing so or being arrested for possession. If he prefers the latter I'm sure the police will oblige him.

Re: Marijuana

Required to assist...no, can choose to , legal niceties all around these circumstances and Counsel is required for the young man for full advisal and protection.
