Legal Question in Criminal Law in California

Misdemeanor removal

I was convicted of misdemeanor grand theft in 1994 in Alameda County, California and put on inactive probation for 3 years. I was told there was a way to have this removed from my record so that a potential employer could not see it. I was an upstanding citizen before this conviction and have been ever since. What I would like to know is exactly which forms I need, where do I get them (I am no longer in Alameda), and to whom do I send them. Thank you, any help is appreciated.

Re: Misdemeanor removal

Contact the Alameda county probation department and ask about the processs for expunging your record. The process may be similar to that used in Santa Clara County. A small fee is paid to the probation office, along with a filled in application. The probation department then does the required research and present the request to the court for the proper signature and order.

An attorney can only assist you in the preparation of the application form, which is very simple to fill out.

Re: Misdemeanor removal

The process of removing your criminal record from public access is called an expungment. This process can be done after you have sucessfully completed probation. We would need to know what the case number is, which court it was in, date of conviction, and what the formal charge was. Please provide this information and we can get started on this for you. Contact our office at 310/277-1707 at your earliest convenience.
