Legal Question in Criminal Law in California

my mom had barrowed my car, because she owns part of it, she barrowed my car for a trip she went on, and i used her truck for work purpose., She is perscribed to vicodon, muscle releaxers due to server problems with shoulder from horse fall. I was pulled over because my tags had no come in mail yet. I was pulled over, I do not take drug, never have, never will ,he ask to search car, i said sure i have nothing to hide. In the trunk was a camera container which had 1 vic and some avil. Must of rolled out of my mom bag. I was arrested. I have a court date for the 4/08/10 i was gonna say "not guilty" my mom gave me her bottle with her name on it, the date, she gave me paper work to what she prescribed to etc. I have never been arrest, never been to jail. i am the first in my family to go to college, trying to do something with my life, i dont need this felony on my records. please let me know, anything you have to say will help. I called the police she said it was a misdomenior.

the question is i want this to go fast as possible. im missing time to go to court from school. Im going to plead not guilty give them my moms proof. i cant go to drug classes, because i go to work from 5am-6pm then school.

Get a lawyer. If you can't afford to hire one yourself, get a public defender. Don't say anything to the court, the police, the prosecutor or anyone else about the case until you have a lawyer. You have too much at stake, and you know too little about the system, to represent yourself.

Well, you at least had one right idea, to find evidence to prove it wasn't your drugs. Other than that, you don't understand the system. If you plead not guilty, the case is set for trial with various pre-trial hearings, during which process your attorney will be able to use your evidence to try to get the charges dismissed You shouldn't be offering to plead guilty and take a drug diversion sentence unless you are guilty of the crime charged.
