Legal Question in Criminal Law in California

My parents put my boyfriend in jail when they found out i was pregnant since im a minor and he is 23. turns out he is getting out in january by that time i will be 18 he has 5years probabtion and a restraining order of 100 ft away from me , can he still marry me?
