Legal Question in Criminal Law in California

parole violation

a friend was paroled from Ca. prison 11 years ago from drug charges. He violated by leaving the state. Would he still be wanted or is there a statute of limitations?

Re: parole violation

He would still be wanted. Your friend did not complete his sentence, and such things do not simply go away with time. He is a fugitive from justice and will remain a fugitive until he resolves this problem, is recaptured or dies. Statutes of limitation apply only to the filing of charges, not to carrying out a sentence.

Re: parole violation

Warrants are forever, and he has one outstanding for his arrest. The proper thing for him to do is voluntarily submit himself to the court with an attorney and work out the best 'deal' he can. IF he has NOT been in further trouble, his attorney MAY be able to keep him out of jail. Have him contact me if serious about clearing this up, IF the case is in SoCal courts.

Re: parole violation

Unfortunately, there is no statute of limitations on arrest/bench warrants. First step would be to find out whether indeed there is a warrant out. Second step would be to hire a competent attorney to work out the best deal and terms of his surrender.
