Legal Question in Criminal Law in California

penal code 69

21 year old son was arrested on pc 69, threatening an officer (told him he was going to kick his ass), first arrest for anything, was intoxicated at a party. Is this a felony or a misdemeanor? He is also in the army and leaving for basic training shortly-what now? first court date is in 2 weeks, before his date to leave for army.

Penal code section 69 can be charged as either a felony or a misdemeanor. depending upon the exact conduct, the attitude of the police officer, and the DA it could be charged as a misdemeeanor. HIring an attorney to represent your son as soon a possible would be a good investment. A discussion with the DA before charges are filed may be helpful in helpin the da make the decision to charge this a s a misdememanor.
