Legal Question in Criminal Law in California

If i plead guilty to a possession of a controlled substance charge, and not guilty to a possession with intent to sell and driving on a suspended, have since gone sooner, gone back to school and am six months pregnant, is there any chance I can get probation and prop 36 instead of jail time?

Prop 36 is very fact specific. You need to talk with your lawyer, who can go over your history, any other charges against you, and evaluate with the proper information.

If the two charges are in the same complaint generally you cannot get Prop 36.

Effective plea-bargaining could possibly get you the outcome you desire.
