receiving stolen property

police poss. on a tip, came into the house through the windows.

they had a list of stolen items,

some of which they found matching items.

then they handcuffed us and said

to our mom were going now to get a warrant!! isnt it to late?

the main resident wasnt home at the time. [ RINGLEADER ]

BECAUSE HE IS NOT HOME,,

he does'nt get charged??

Whether people get charged is up to the DA. Whether you have grounds for suppression motions depends on the facts and documents. Consult with local counsel, you'll need an attorney.

Whether or not the search is valid would depend upon the facts the police relied on to justify the entry. As for the ringleader not being charged because he was not there will not result in the charges against you being dismissed. retaining an attorney to represent you is the best option for you as this time.
