Legal Question in Criminal Law in California

registration 290

Is there any legal way to apply so a sex offender no longer has to register? Especially if the crime has been expunged, and not a molestation or rape case. This person just made a mistake and had sex with a minor 1 time. He does not belong with the rapist and molesters.

I heard a little something about a form that has something with a title of rehabilitation, or something like that??

Re: registration 290

Thank you very much for your posting and your inquiry.

The form you speak of is called a certificate of rehabilitation, but that may not help avoid the lifetime registration requirement of PC 290. Your "friend" may want to do an appeal, or make a motion based upon newly discovered evidence or factual innocence.

I hope that this information helps you, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at rmiller@expertlawfirm.com. It's my pleasure to assist in any way that I can.
