My husband was convited of spousal abuse and I am the victim. He was told that we can not have any contact upon his release. If it is my choice as the victim and would like him to come home, would we be able to fight that? It's such a burdan tying to provide for 2 house hold and the seperation for the kids is really hard.

Can you fight it? Sure, by having your husband file a motion to modify the terms of parole/probation. With your testimony, it may be possible. Feel free to contact me if interested in doing this right, and the case is in SoCal.

He may be allowed peaceful contact if you agree. He should also enroll in any domestic violence course that is available while he is in custody. Then you should obtain information on domectic violence programs that are available in the area where you live. This will increase the probability of the change in his probation or parole allowing peaceful contact. If he is on parole you should also include a request that you and he can live together. Parole conditions are often more stringent that probation conditions.
