Legal Question in Criminal Law in California

You replied - get a lawyer

My friend submitted a question to lawguru.com and the attorney advised that she get a lawyer and don't talk to anyone else about the matter. I wholeheartedly agree that she should do exactly that. Problem is - money. Should worse come to worse she will be appointed a public defender - until then, she's on her own. I know that when there is a lawsuit that might award monetary benefits some lawyers will work on contingency - is there any thing like that possible for her?

Tell your friend to do two things: First, call the public defender. Someone over there will tell her if she qualifies. If she wants private counsel, call around. There are many attorneys who will handle certain cases on a flat rate. Some may even reduce their fee for her. Just because one attorney quoted her a fee, does not mean everyone will be at the same fee. A lot of DUIs are handled on flate fees, as are quite a few misdemeanors. I handle most misdemeanors on a flat rate. I know others who do as well.

In a criminal case there is not pot of gold at the end of the case as there is in a personal injury case. Where would the money to pay the attorney come from?
