Legal Question in Criminal Law in California

Statute of Limitations

I was arrested by U.S. Secret Service for posession and manufacture of counterfeit currency. Made a motion to supress evidence due to an injust search. The motion was granted and my case dismissed. Here I was told that the state may now file charges against me for the same incident. How long do they have to file?

Re: Statute of Limitations

Thank you for your posting and your inquiry.

The statute of limitations truly depends on the charges filed against you. Although the state can't file federal charges, I can think of about 10 different potential charges, including fraud, which, depending on the amount, could be felonies, subject to a statute of limitations of three years or more.

It might be safe to say that I can't truly give you an accurate answer to your question without additional information.

I hope that this information helps you, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at rmiller@expertlawfirm.com. It's my pleasure to assist in any way that I can.
