Legal Question in Criminal Law in California

My stupid brother just got arrested in Lancaster, California for getting extremely drunk; discharging a firearm; drinking and driving; crashing said car into neighbors house, and possession of an illegal firearm (40 round magazine). He was on a private road the whole time, but it led to a public road in very short order. He is 34 years old and has no priors that I know of. He has kids but they are living separately with the mother so no excuse to take care of anyone. He also has no medical condition to blame, other than pathological liar and a$&hole;. Did I mention hes really, really stupid? is there a legal defense for really, really, stupid? I just want to know what kind of punishment the dumb dumb is looking at. Any help in determining that fun fact would be much appreciated.
