Yes, but only if they knew that what they reported to CPS was false or made it with reckless disregard of its truth or falsity. Not if they had "reasonable suspicion" to report you. That would be a civil suit, not a criminal matter. As for withholding items, you can bring that up with the court in the lawsuit.
