Legal Question in Criminal Law in California

Urgent update on Positive Drug Test Probation Violation

Daughter was sentenced to Drug Diversion Program, four counts narcotics one felony. She has been depressed for over 5 years. Tested positive for drugs & going to court in 2 weeks. Was given advice. Radical change today. Last night I found her on floor with knives all around, cutting herself. She is severely depressed, needs immediate intervention. Do I wait till court date? Will judge put her in an inpatient program instead of jail? Should I call PO, call Prosecutor, get Court Appointed Defense Attorney & explain problem? How do we inform him of her mental health problem? I'm afraid of suicide next. She is 21.

Re: Urgent update on Positive Drug Test Probation Violation

You should obtain medical records supporting her current condition. Then retain an attorney to assist her or the public defender. Present these medical records to the attorney to present to the court and the probation department.
