Legal Question in Criminal Law in California

Violation of Penal code 422

I'm being arraigned for pc 422. I recently left the Army after coming back from afghanistan now navy reserve. I was in my car with my girlfriend when we were leaving a parking lot to go onto the street. This vehicle had it's turn signal to go into the parking lot, we were about to go into the street. but the vehicle turned it's signal off and headed straight. We stop from going into the street and the vehicle stopped in front of us, he had plenty of space to continue but held us against our will by parking in front of the driveway for about a min. I went out of the car and to the passenger side to tell him to move. He was of a middle eastern so it was hard to understand. I told him to move. I was going back to my car and both of us yelling at each other when he got out of his car and came towards me. Leaving the car parked on the street blocking us and traffic. I told him that he could get killed for doing that. When he heard the word kill he said that's a terrorist threat, that's when I got upset and got in his face and told him that I fought against terrorist. I left and the police contact me a week later. I told them the story and never heard from them again until I received the arraignment paper. Is their any help for me ?

It will be his word against yours, and so there's a good chance this will go to trial. You should retain an attorney to negotiate this for you.

Whatever you told the police officer must have convinced him that you committed a violation of the statute. You'll want to hire an attorney to obtain all of the evidence against you, including your statement, the statement of the witness, and the police report, and then obtain the rap sheet of the "victim." Depending on how these look, you can decide whether to negotiate with the prosecutor or fight at trial.
