Legal Question in Discrimination Law in California

i am a 16 year old girl who had sex with a 15 year old boy. i got pregnant and my parents kicked me out and i was living with him. my parents asked me to return home but i refused they then called the police and they told me that what i had done was illegal and now they are charging me and my boyfriend with that. they say that we can get charged with rape. is that even possible

Not only is it possible, but your boy friend is definitely guilty of statutory rape [having sex with a minor woman], whether or not you agreed to it. That you do not want to press charges does not matter; if the birth certificate has his name on it as the father or the police get DNA samples to show he is the father, the case is clear. Some police departments will not arrest a minor male who is younger or the same age as his female companion, but legally they can.

Your parents have you over a barrel; if you do not behave as they want, they have a good chance to get your boy friend sent to junivile detension. You can not be charged with rape, but could be charged with some lesser crime. Both of you need to reach some type of understanding with all the parents involved. You can not raise a baby without money, normally you can not earn a decent salary without more than a high school education.

I am sorry that you are in such a bad situation, but you also have to consider who caused it.
