Legal Question in Discrimination Law in California

Mobile Home Association's Rights

I have a mobile home for sale in a 55 and older park. I have a buyer who is disabled and in a wheelchair who will--name removed--55 in five months. The buyer's park is closing and she has nowhere else to go and must move within 30 days. Can my park refuse to allow me to sell my home to this buyer purely based up the age restriction as I would love to sell this home in a very tough market.

They would be on dangerous ground to deny. You might have to have an attorney 'persuade' them with a letter if they try.

Technically, yes the park can refuse to accept the buyer as a tenant of the park. I would, however, think that they might accomodate your request given the circumstances. Unfortunately, age 55+ parks have been granted a unique exception to the laws that govern age discrimination, and its a pretty absolute law. I'd have a discussion with the park manager, and if that doesn't work, then the off-site management company supervisor.
