If you are convicted of the DUI, there is nothing you can do to retain your license, and it will be stripped for at least 12 months. This means your best chance to retain your license is to hire an attorney and fight the charge. Depending on the police report and your blood alcohol concentration, you may have a chance to win this.

Good Luck!

You will really need to fight on this one but we would need more info to advise further. Contact a criminal defense attorney and discuss your case with them.

The devil is in the details--a lot will depend on the precise facts of your case and the quality of the evidence against you. You need to retain a lawyer who does DUI, who will take the time to investigate and conduct discovery and properly prepare for settlement or trial. Separate from the criminal case, you must request a DMV hearing within 10 days of the stop; otherwise, your license will be automatically suspended. You can do this yourself, if time is running out and you do not yet have an attorney; otherwise, have your attorney do it. If your traffic stop was in or near the San Francisco Bay Area, feel free to contact us. See www.duilawyercalifornia.org.
