Legal Question in DUI Law in California

Accident/dui

My husband was killed in a car accident. He hit a off duty sheriff(who cut him off)the sheriff left the scene(no safe place to stop)it took him over seven minutes to return. Now they are saying my husbands bac was .28% on one test, and .32% on another. The test results(bac) they sent to my lawyer say they was taken the night he died. The test results they sent me say they were taken 18days after his death.(i received my report first) the corner said he smelled a slight order of acohol. The police reports states the smell was strong in the car as well as on my husband.(no wasted acohol in car) i say they are covering for the officer. He was not given a bac test. And the police report was held 5months, even though it was finished a month after the accident. How can i find out the true bac? And know the samples were not tampered with? I'm i allowed to send them to my own lab? And do two counties normally handle the same bac samples?
