Legal Question in DUI Law in California

alcohol swabs used in blood testing for BAC

is it true that if a alcohol swab is used to clean the site where the blood is drawn, instead of betadine, will it increase your BAC, if so where can i find the Standard operating procedure stating that you are not supposed to use alcohol, and it increases BAC.

Re: alcohol swabs used in blood testing for BAC

You should look in Title 17 of the California Code of Regulations for that answer. If you have evidence like this, you should present that at trial and the DMV hearing.

I doubt that using an alcohol swab affects the blood test. Even if it did, you would need to have a lawyer present expert witness testimony to that effect. Your looking it up won't help much.
