Legal Question in DUI Law in California

Appeal to reduce 3 years probation?

I had a first DUI, but did not want to spend time in court to appeal so I agree with the judge' sentence for 3 months DUI program with restricted driving lisense and 3 years probation( can not drive with any measureable amount of alcohol). Now, I change my mind and want to appeal to reduce the number of years of probation. Is it possible?

Thanks and best regards

Thank you for your posting.

Yes, it is possible to reduce probation. Penal Code 1203.3 allows for a motion to terminate probation, or modify probation, as necessary. You have to bring a written motion, and notice and serve the DA's office, but it can be done.

Appeal - NO. File motions to reduce the probation, yes if there are grounds for it. Contact me if interested in doing so.
