Legal Question in DUI Law in California

I got areested for a dui in august of 2010 i went to court on the date that was shown on the ticket however they did not have my ticket filed its febuary the 15 of 2011 now and i still havent herd from them what do i do ?

The statute of limitations is how long they have to file charges against you. On a misdemeanor DUI, it's one year. IF they don't file charges within that one year, then you win. You're halfway there. I don't know why it's taking so long. A couple of months is the usual delay. You could be one of the rare ones that the paperwork got lost, misfiled, etc.

If you don't have an attorney, it may be worth getting one to quietly check into things without forcing them to find the case and file. Meanwhile, don't do anything that will make the police and/or DA go looking for your case to file charges against you.

Check with the court clerk to make sure whether charges were filed or not. You may have been notified by mail, and not gotten the letter. If no charges were filed, just sit tight.
