Legal Question in DUI Law in California

I have been asked to write a character reference letter for a friend's boyfriend. He was arrested for a DUI and apparently this is not the first time (something I did not know). I have only known him for 1.5 years and have never really spent a lot of time around him. Most of my knowledge of him is by what she has told me. He is facing 18 months in jail for this arrest and his lawyer is asking for him to provide character references to lessen or remove the jail time. I am not sure if I am the right person to write this for him and I do not have any experience with what he chooses to do after drinking. If I did write anything it would be very generic with no details or examples regarding his behavior and drinking responsibly.

It sounds as if you don't want to write the letter. If you feel uncomfortable about writing the letter than I suggest you don't write it. You could also write a letter that includes the facts that you've known him for 1.5 years and further explain the circumstances of your knowledge of him. If you feel uncomfortable telling them you don't want to write the letter, then write a letter that is just facts and let them decide to use your letter or not use it.

When I ask my clients for these types of references I want people who have known my client for a long time and who can put things into the proper perspective. Don't lie and just provide the facts.
