Legal Question in DUI Law in California
DUI arrested
do I need a lawyer for the first offense and not yet determine what my alcohol level is...Do the police have the right to take my breath four times and was not reach to the .08 bc and still convicted in jail???

Yes. You could be DUI but not .08 DUI. If you are under the influence of something such that your driving is impaired, you can be arrested for DUI. But it sounds like you might have a defensible case anyways. Consult with an attorney.
