Legal Question in DUI Law in California

dui with bac .04

I am researching for a friend,

He states he was at a bike show all day, he had a couple of beers, after a few hours left, it was 2am, he saw a veh with highbeams approaching fast, thought the car was going to hit him, he accelarated, the veh did the same, he increased his speed, the veh same, then threw the lights = CHP, he admitted to two beers, refused blow wanted blood = BAC .04

any defense available? been thru 3 court appointed and one hire whom added a charge not previously there..... Help!

Your friend will have to consult with an attorney so that all of the facts of the case can be discussed. With a ba of .04 you should be able to mount some kind of defense.
