Legal Question in DUI Law in California

dui ?

if a person has 3 prior dui's and on the 4th dui he gets in an accident and the back seat passenger dies, what chances does he have on going to trial and getting involuntary manslaughter. if the persons intentions were to spend the night at there friends house and the couple got into an argument and made everyone staying the night leave at 2am in the morning.

This questions cannot really be answered. It is a question that gets a lawyer answer of "it depends", any lawyer who would guess is an attorney I would not hire.
