Legal Question in DUI Law in California

Dui Violation
I had a dui 3 years ago. Recently my friend was driving and got pulled over driving under the influence. I was in the passenger side and the cops pulls us over and arrest both of us. He told me I was charged for public intoxication, which is FASLE because I was in the car. Then when he pulled my records he said I was also charged for a probation violation that I had 3 months left on from a previous dui . I spent a night in jail and have to go to court soon. What will happen? What should I plea because I really wasn't drunk in public. I want to fight this but at the same time I really can't afford a lawyer. Please help.
