Legal Question in DUI Law in California

My youngest son who is 24 never been in any kind of trouble, has a class B (or had) could drive hazzord materials, well he got a DUI got in an accident crossed over hit a lady in a van totaled both vehicles her heal got broken and had to have surgery, he had full coverage great insurance. What can er say to help him h has a public derfender who really doesen't seem to be trying for him we understnd how serious this is and he has stopped drinking is attending AA cllasses on his own. he was told he could do any where as 180 days up to 3 years in State prison, he is 24 yrs old county jail would be bad enough but State he really is a good kid, is there any thing thing we could say or do? What about the Bar that served him and let him leave drunk don't they have any responability? any info on how we can help him would be great, THANK YOU SO MUCH

As you stated, your son is obviously facing a serious crime. A DUI by itself is already serious, let alone a DUI with injuries.

Although skilled from experience by being in court everyday, the public defender as you have found simply does not have the time to devote to one particular case over another.

There are no magic words that your son can say to lessen the gravity of the situation he is in. The best course of action is to hire a private criminal defense attorney that will have time to review the reports, conduct an independent investigation and find every possible legal defense available, or at least try to mitigate the circumstances to ensure your son doesn't see a state prison. There are various deals that can be worked out.

As for holding the bar responsible, that will have practically no effect on your son's criminal trial and is generally a long shot for civil liability.

Speaking of civil liability, unfortunately for your son, if it hasn't already happened, you should expect a civil suit filed against your son by the victim in this case. Even worse is that most insurance companies will not cover damages their insured causes while driving under the influence. Your son's legal troubles will almost certainly mount.
