got a mist dui alcohol arrested released it was a collision in company truckblood came back 0.00 four months later they file for drugs in my blood i was set up or wrong blood but they offered 180 days do to my past history anyone else gets a program.im clean doing well got a good job and single parent to a 9 yr old boy why wait four months to say drugs when it was only alcohol cop even said in report smelt of alcohol bad and all alcohol symtems

Is there a question here? "Offered 180 days" says to me you've already been to court. Drug DUIs are not very hard to beat if you have an experienced lawyer who cares about what happens to you. The fact that they waited four months can be useful, for example your attorney can argue you were denied the right to a speedy trial. If I were your lawyer I would ask for a split sample of your blood and send it to an independent lab. Maybe the sample has degraded by now.

You will need to fight the charge. You will want to see every discrepency in the report and do research on background of cop who did the tests and blood split and other things may need to be done to build a defense.

Prop 136 and DEJ do not get rid of DUI charges. Fire your current lawyer, and also, your commercial driver's license is gone if you do not fight now.

I do not understand your question. It appears as though you are providing the general facts in hopes of getting enough information to find out how to fight what is going on. Telling us why you don't understand what the DA did, or why he did it, simply proves the point that you need to have an attorney, unless you are willing to go to jail as offered.

You'll get your explanations about what and why they did things, but only when your attorney gets and reviews all the discovery documents and other evidence. Once he has all the pleadings and police reports, then your attorney can determine if there are grounds for evidence suppression or other motions, or defenses to use in plea bargaining or trial. Without knowing all those factors, there is no way to provide you any opinion.
