My nephew is being charged with the following:

11359 HS Possession for sale of marijuana

11377(a) HS Possession of a controlled substance

11357(a) HS Possession of concentrated cannabis

11358 HS Cultivation of marijuana

He has no priors, 20 yr. old college student with part time job. What is the likely sentencing?

You're asking for rampant speculation. He faces at least 4 charges that carry 6 -12 months each. The real answer will come from negotiations with the DA and court at the time of his Pre-Trial hearing. Yes, with no priors it is possible he could get no jail time, and a diversion program without jail is a possibility for a first timer, but there is no way that can be guaranteed. Anyone issuing guarantees is definitely misleading you. His attorney will present the best possible view of him and his background seeking a no jail outcome.
