Legal Question in DUI Law in California

How should I plead to a DUI charge with a minor in the car? I was arrested and told I was being charged with wilful cruelty to child. My BAC was 0.09. This is my first offense. I have a clean DMV record and have not been convicted of any crimes. Pelase also tell me what penalties I am facing.

YOU MUST GET AN ATTORNEY. If they charge you with the endangerment of a minor, you could go to state prison and lose parental rights. Generally this charge can NOT be maintained with such a low alcohol level.

In Fact, a good attorney will be able to have that charge dismissed and have the DUI reduced to a lessor charge thereby saving you money, time in custody, and possibly your license.

Mr. Kapsack is correct. Author of "Innovative DUI Trial Tools," you would be hard-pressed to find a better California DUI Attorney. See http://www.jamespublishing.com/books/dui.htm .
